Unless you have a CARB sticker for it, they can fail you for it. Most people wont give a shit unless you have modified the EGR, Charcoal Canister, or any other emmisons device.
Nothings exempt from California smog.
All aftermarket parts that are not stated as OEM must have an Executive Order (EO) to be smog legal. But chances are, if you have an aftermarket intercooler, you the guy won't notice or make a big deal about it unless he's an A.....H.......
Most major brand companies like Greddy, HKS, Spearco, and so on, will have spent the money to get an EO for their products. An EO just says that the manufacturer has proven to the State of California that their product does not alter emissions.

Oh......I forgot to mention, if you have an item with an EO, print a copy of it from the website and keep it in the glove box. A smog inspector will want to see it.
